PROPOSED LAND USE REGULATIONS CHANGES
Draft regulations changes as proposed by Douglas County Environmental Services staff and contracted planning consultant, Community ReDesigned are available for review and comment. Most of the changes are in regards to complying with the requirements of our NPDES Phase II Stormwater Permit and to be consistent with the Douglas-Washington County Stormwater Management Policies that were adopted by the Douglas County Board.
To facilitate review of the proposed changes the drafts are prepared in legislative format with proposed additions noted by underline and proposed deletions noted by strikethrough. The following sections of the Zoning Regulations, Stormwater Management Regulation, and Comprehensive Plan are attached here:
1. Stormwater Management Regulation (22 pages). Changes are proposed to sections I, III, IV, XIX, XX, and XXI. Note that original section XXI is proposed to be deleted and “exemptions” combined into new section XIX. (Note: The Table of Contents formatting error will be corrected for the final version).
2. Zoning Regulations, Article 4 Zone districts (pages 4-10 to 4-30 of that Article). A “Note 4” has been added to the AG district to allow 2 residences on parcels 40 acres or greater.
A new section “Compliance with the Stormwater Management Regulation” has been added to all of the other zone districts; the language seeks to provide flexibility with respect to setbacks and impervious cover regulations in order to meet the requirements of the Stormwater Management Regulation.
3. Zoning Regulations, Article 5 Supplemental Use Regulations (page 5-3 only). Proposed deletion of item “c” under the Permitted Accessory Uses for the MH (Mobile Home) District.
4. Zoning Regulations, Article 7 Conservation Design (entire section, pages 7-1 to 7-10). Minor language changes to clarify intent and provide trail linkages information.
5. Zoning Regulations, Article 12 Non-Conforming Development (entire section, pages 12-1 to 12-4). Adding a new section 12.04 B. to provide clarification on “reestablishing” a structure.
6. Zoning Regulations, Article 13 Administration and Procedures (pages 13-1 to 13-3 only). Adding a phrase to section 13.03 D. to increase the flexibility in evaluating applications. The intent is to allow staff to reduce the Site Plan Review requirements for smaller scale development situations in situations where the development is smaller scale and not all of the requirements are relevant.
7. Comprehensive Plan First Principle #3 (page 36 only). Proposed language change to reflect the Stormwater Policies adopted by the County Board with respect to development in the flood plain. The proposed language seeks to clarify differences between floodplain development in the Papillion Creek watershed and the floodplain that exists between the Elkhorn and Platte Rivers.
